Illinois Landlord Tenant Act (765 ILCS 720) requires landlords to maintain rental units in 'good repair.' Chicago has additional strong tenant protections under the RLTO.
Repair Timeline
14 days after written notice for non-emergency conditions; immediate for flooding or emergency
Rent Withholding Rights
Chicago RLTO allows rent withholding with specific procedures. Statewide, repair-and-deduct is allowed for amounts up to half of monthly rent after proper notice.
Chicago and Cook County have high risk of sewer backup flooding (combined sewer system). A sewer backup rider on your renter's insurance policy is strongly recommended.
